Terms of Service

These Terms of Service ("Terms") govern your access to and use of BrainTrellis (the "Service"), operated by Brightwing Systems, LLC ("Brightwing Systems", "we", "us", or "our"). By creating an account, sending a message to the Service, or otherwise using BrainTrellis, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BrainTrellis is a personal note-capture and retrieval tool. You can capture notes from the web and, where enabled, by text message (SMS/MMS) and other messaging channels, and search them in a private feed. Features, channels, and limits may change over time.

2. Eligibility & your account

You must be at least 18 years old (or the age of majority where you live) to use the Service. You are responsible for the activity under your account and for keeping your login credentials secure. Tell us promptly at support@braintrellis.com if you suspect unauthorized use.

3. Trial, pricing & payment

BrainTrellis is offered with a free trial period, after which continued capture requires a one-time purchase. The current price is shown at sign-up. Payments are processed by our payment processor (Stripe); we do not store your full card details. Except where required by law or stated at purchase, payments are non-recurring and there is no subscription. Our refund policy, if any, is the one presented to you at the time of purchase.

4. Messaging & mobile terms

If you connect a phone number, you consent to exchange messages with the Service for the purpose of capturing and managing your notes. Message and data rates may apply. Message frequency varies based on your use. Reply STOP to opt out of messages and HELP for help. Opting out may disable text-based capture. Carriers are not liable for delayed or undelivered messages. You represent that you are the account holder or authorized user of any number you connect.

5. Your content

You retain ownership of the notes, text, images, and other content you submit ("Your Content"). You grant Brightwing Systems a limited license to host, store, process, transmit, and display Your Content solely to operate and improve the Service for you. We do not sell Your Content, and we do not use it to train third-party advertising models. Optional AI features are described in Section 6.

6. Optional AI enrichment

Some features (such as automatic tagging or natural-language reminders) are powered by third-party AI providers and are off by default. If you enable them, the relevant note content is sent to that provider to produce the result. We work with providers under a no-training and limited-retention posture where available. You can disable these features at any time in your settings.

7. Acceptable use

You agree not to use the Service to:

• break the law or infringe others' rights;
• store or transmit malware, or attempt to disrupt or reverse-engineer the Service;
• send unsolicited messages, or use another person's phone number without authorization;
• upload content that is unlawful, or that you do not have the right to store.

8. Third-party services

The Service relies on third parties (for example, messaging, payment, hosting, email, and AI providers). Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.

9. Availability & changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features. We may update these Terms; if we make material changes, we will take reasonable steps to notify you, and continued use after the effective date constitutes acceptance.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or to comply with law. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be error-free or that notes will never be lost; keep your own copies of anything critical.

12. Limitation of liability

To the fullest extent permitted by law, Brightwing Systems will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim, or USD $50 if you paid nothing.

13. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of- law rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where applicable law provides otherwise.
